Mediation is the better alternative to litigation in settling a dispute in court. Litigation involves a “winner-take-all” approach and comes with a roll of the dice in terms of the outcome/result/consequences for the parties.

In mediation the Mediator is a neutral that can help the parties resolve their conflict in a process that strives to identify a resolution that is a win-win for the parties.

In essence with the help of the Mediator the parties can decide upon their own resolution to the conflict as opposed to leaving the resolution to a third party judge to impose an end to the conflict. Furthermore in Mediation a resolution can be accomplished in much less time and money versus litigation. Mediation often affords the parties the opportunity of maintaining a working relationship going forward.

Mediation Experience

Michael is a dual citizen of USA/Germany (EU). He has worked in a senior management capacity for the largest design and construction companies in the world.

As Contracts Manager for Turner Construction Company, a subsidiary of Hochtief, he was responsible for over $100 million dollars worth of contracts annually.

Michael in a similar capacity for CRS Sirine, acquired by Jacob’s Engineering, was involved in approximately $1 billion annually of design, construction and program management contracts.

By virtue of his experience he served as an arbitrator in over 100 hearing days on complex construction claims.

International Experience

Experienced Developer

Michael created and managed his own commercial and residential development company. As a boutique developer he successfully developed office and custom residential properties exclusively in Winter Park, Florida.

Prior to establishing his own company he worked with several large international developers to include Disney, Olympia and York (Reichmans) Galbreath, Lincoln and Swire Properties among others in his capacity with Turner Construction Company and CRS-Sirine, now Jacob’s Engineering.

Divorce Mediation
Divorce mediation can be effective when the parties have a disagreement about their divorce settlement. It’s a prudent alternative to choosing protracted costly litigation to resolve the disagreement.

Construction Mediation

Construction projects involve tight schedules and deadlines. Projects can be delayed or stopped during a dispute an extremely costly event for both parties. Mediation is more likely to resolve your dispute quicker than litigation which usually means substantial cost savings for all parties involved in the dispute as well as a faster project completion. Construction and design disputes can be highly technical in nature which the parties may not want to be resolved by a judge. Mediation is a non adversarial process that allows the parties to come to a flexible collaborative resolution. Michael Pabalis for 25 years has beeen mediating complex construction claims involving millions of dollars with positve results.

Commercial Mediation
Commercial Mediation is designed to resolve conflicts in a way that is less formal, less adversarial and more accomodating to the needs and interests of all the parties involved, in essence promoting a collaborative approach to dispute resolution versus a " winner take all" litigation approach.

FEES + TERMS

Quality mediation principles require transparency and fairness. While fees can be dependent on the type of case and parties involved, we attempt to adhere to the following mediation fee schedule and terms:

Divorce and Family Mediation 
(1) 2-Hour Session $450

Construction and Commercial Mediation
(1) 2-Hour Session $500

There is a (2) hour minimum fee which must be received at least 24 hours before the scheduled start time for the mediation. There is no charge for all reasonable time required for scheduling or preparing for mediation including and review of materials submitted.

Cancellation Charge
In the event that a mediation is cancelled less than 24 hours before scheduled date , the party requesting the cancellation will be charged a cancellation fee. If all parties request a the cancellation , each party will be billed a pro rata portion of cancellation.
There is no charge for any re-scheduling agreed to by all Parties at least 24 hours working-day hours before the scheduled mediation.
